iFEST Affiliate Disclosure & Terms
1. Affiliate Relationship Disclosure
By participating in the iFEST Affiliate Program, you acknowledge that:
- iFEST may provide affiliate links that allow you to earn commissions from referred sales.
- When users purchase through your unique affiliate link, you receive a commission as per the stated percentage on qualifying sales.
- The iFEST Affiliate Program operates under a performance-based structure, meaning commissions are only earned when a valid transaction occurs.
- iFEST reserves the right to review, approve, or reject affiliate applications at its sole discretion.
2. Earnings Disclaimer
- There is no guarantee of earnings through the iFEST Affiliate Program. Your results depend on the effort you put into marketing and promoting iFEST products or services.
- Past affiliate earnings do not indicate future success.
- iFEST is not liable for any losses incurred from an affiliate’s inability to generate sales or commissions.
3. Affiliate Commissions & Payments
- Affiliates earn 20% commission on all qualifying sales made through their referral link.
- Commissions are only payable once a transaction is verified and cleared.
- Payments are made via PayPal or direct bank transfer, depending on the affiliate’s selected method.
- Affiliates are responsible for providing accurate payment details. iFEST is not liable for incorrect or delayed payments due to inaccurate information.
- Commission payments are subject to a minimum payout threshold (if applicable).
4. Non-Liability Terms
- iFEST does not assume liability for any third-party claims, damages, or losses arising from an affiliate’s promotional activities.
- Affiliates must comply with ethical marketing practices and are strictly prohibited from using spam, misleading advertising, or false claims.
- iFEST is not responsible for technical errors, website downtimes, tracking issues, or system malfunctions that may temporarily affect affiliate performance.
5. Compliance & Legal Responsibilities
- Affiliates must disclose their relationship with iFEST when promoting through blogs, social media, or any public platforms, in accordance with FTC (Federal Trade Commission) guidelines or equivalent consumer protection laws in their country.
- Any form of deceptive marketing, false advertising, or fraudulent referrals will result in immediate termination from the program and forfeiture of commissions.
- Affiliates are responsible for any applicable taxes on their earnings. iFEST does not handle tax-related obligations on behalf of affiliates.
6. Termination & Modifications
- iFEST reserves the right to modify, suspend, or terminate the Affiliate Program at any time without prior notice.
- Any abuse of the system, breach of terms, or unethical behavior will result in immediate removal from the program and potential legal action if necessary.
- Changes to affiliate commission structures, payout schedules, or terms will be communicated to affiliates when applicable.
7. Agreement & Acknowledgment
By participating in the iFEST Affiliate Program, you confirm that:
- You have read and agree to these terms.
- You will adhere to ethical marketing practices and comply with all applicable laws.
- You understand that iFEST is not liable for your earnings, expenses, or business operations as an affiliate.
8. Modification of Terms & Program Updates
- iFEST reserves the right to update, modify, or terminate the Affiliate Program at any time.
- Affiliates will receive reasonable notice of any significant program changes.
- Continued participation in the program after updates means acceptance of new terms.
9. Intellectual Property Rights
- Affiliates do not acquire any ownership rights to iFEST trademarks, logos, branding, or proprietary content.
- Affiliates may only use approved marketing materials provided by iFEST for promotional purposes.
- Unauthorized use of iFEST’s intellectual property (logos, images, slogans) in a misleading manner may result in legal action and immediate account termination.
- iFEST reserves the right to revoke any affiliate’s permission to use its intellectual property if misused.
10. Compliance with Laws & Regulations
Affiliates must:
- Follow all applicable laws and regulations related to marketing, advertising, and online promotions.
- Ensure compliance with GDPR (General Data Protection Regulation) if targeting audiences within the European Union.
- Avoid deceptive or misleading advertising practices that could result in legal action.
- Be aware of local tax obligations on affiliate earnings and declare their income accordingly.
Failure to comply with applicable laws may result in suspension or permanent termination from the affiliate program.
11. Independent Contractor Status
- Affiliates are independent contractors and not employees, agents, or representatives of iFEST.
- Affiliates are responsible for their own taxes, expenses, and liabilities associated with their promotional activities.
- iFEST does not provide employment benefits (such as insurance, bonuses, or allowances) to affiliates.
12. Limitation of Liability
- iFEST shall not be held liable for any losses, damages, claims, or financial setbacks incurred by affiliates.
- iFEST is not responsible for failed payments due to incorrect banking details provided by the affiliate.
- iFEST does not guarantee a fixed or minimum income—earnings depend entirely on an affiliate’s marketing efforts.
- Affiliates are fully responsible for any legal claims, disputes, or complaints arising from their promotional activities.
- iFEST will not be held liable for technical issues, website downtime, or external system failures affecting affiliate commissions or tracking.
13. Confidentiality & Non-Disclosure
- Any non-public information shared with affiliates regarding commission rates, upcoming events, marketing strategies, or exclusive offers must be kept strictly confidential.
- Affiliates may not share, sell, or distribute iFEST’s internal data to third parties.
- Violation of this clause will lead to legal action and immediate termination.
14. Termination & Consequences
iFEST reserves the right to terminate an affiliate’s account if they:
- Violate any terms of this agreement.
- Engage in fraudulent activity, false advertising, or unethical marketing.
- Fail to comply with advertising laws, privacy regulations, or FTC guidelines.
- Damage iFEST’s brand reputation through misleading or harmful practices.
If terminated:
- All pending commissions may be forfeited at iFEST’s discretion.
- The affiliate will lose access to their referral links and dashboard.
- Any unauthorized use of iFEST branding must cease immediately.
15. Governing Law & Dispute Resolution
- This agreement shall be governed by the laws of South Africa.
- Any disputes shall first be resolved through internal mediation—if unresolved, they will be settled in a court of law under South African jurisdiction.
- Affiliates agree to waive class action lawsuits and must handle disputes individually.
16. Acceptance & Agreement
By signing up for the iFEST Affiliate Partner Program, you confirm that you:

✔ Will comply with legal, ethical, and promotional guidelines.
✔ Understand that iFEST is not liable for your financial results or personal business expenses.
